Changes in EU Rules for Flight Delay Claims

Following a ruling from the European Courts of Justice, claiming for flight delay compensation with us will be easier.

The Definition of Arrival

The EU rules for flight delay claims have closed a loophole in the definition of “arrival”. Airlines had argued that arrival meant the plane had touched its wheels down on the runway meaning passengers could still be on the plan for another 20 minutes, or more, before disembarking.

The loophole has now been closed so flight delays are calculated up to the point the plane door opens, allowing more passengers to make successful claims.

The Germanwings Flight Dispute

The ruling came following a dispute against a budget airline Germanwings flight which touched down with a delay of two hours and 58 minutes. Passengers were initially refused compensation as it fell under three hours. Thanks to this change is legislation passengers are now able to claim flight delay compensation.
